Fair Work Ombudsman audit – Barossa Valley

The Fair Work Ombudsman (FWO) has announced it will shortly audit 75 randomly selected businesses in the Barossa Valley to monitor compliance with record-keeping and payslip obligations under the Fair Work Act 2009 and minimum wages under Modern Awards. While the audit does not specifically target the wine industry, the FWO has indicated that the inspections will include wine industry employers.

An FWO inspector has the power to enter business premises if they reasonably believe the workplace is subject to the Fair Work Act 2009. Before entering an inspector must show their identity card. While on the premises an inspector may do any of the following:

  • inspect any work process or object; 
  • require a person to tell them who has or who can access a record or document; 

  • require the person with access to a record or document to hand it over while the inspector is on the premises or within a specific timeframe; 

  • inspect and make copies of any record or document kept on the premises; 

  • take samples of any goods or substances after informing the owner or other relevant person;and

  • require a person to provide their name and address.
